Section 1: General Terms & Conditions

Applies to all Skatrium users, including organisers, Skate DJs, Skate Shops, and general users.

1. Introduction

These Terms govern your use of the Skatrium platform ("Skatrium", "we", "us", "our"), including the website and mobile application.

By accessing or using Skatrium, you agree to these Terms. If you do not agree, you must not use the platform.

2. About Skatrium

Skatrium is a digital marketplace and promotional platform for:

  • Roller-skating events

  • Event organisers

  • Skate DJs

  • Skate-related retail merchants

Skatrium operates as a technology platform and marketplace facilitator only.

Unless expressly stated, Skatrium:

  • Does not organise or host events

  • Does not employ or represent DJs

  • Does not manufacture goods

  • Does not act as the merchant of record for independent sellers

Contracts for events, DJ services, or product purchases are formed directly between users and the relevant organiser, DJ, or merchant.

3. Marketplace Role Clarification

Where transactions occur via the platform:

  • Skatrium facilitates payments and may collect commission.

  • Skatrium is not responsible for fulfilment, delivery, performance, or product quality.

  • The relevant organiser, DJ, or merchant remains solely responsible for service delivery.

4. Eligibility & Age Requirement

4.1  You must be at least 18 years old to create an account and use Skatrium.

4.2  If you are aged 13–17, you may only use the platform with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.

4.3  By using Skatrium, you confirm that you meet the applicable age requirement. Skatrium reserves the right to suspend or remove any account where this requirement is not met.

5. User Responsibilities

You agree to:

  • Use the platform lawfully

  • Provide accurate account information

  • Accept that participation in events or purchases is at your own risk

  • Contact the relevant organiser, DJ, or merchant directly regarding disputes

You must not:

  • Post illegal, defamatory, or abusive content

  • Manipulate reviews

  • Engage in fraud or scams

  • Attempt to bypass platform payment systems

6. Payments & Fees

Skatrium may charge:

  • Subscription fees

  • Featured listing fees

  • Promotional fees

  • Commission on sales

  • Transaction processing fees

All fees:

  • Must be paid in full and on time

  • Are exclusive of VAT unless stated

  • May be amended with reasonable notice

Failure to pay may result in suspension of listings or storefronts.

Payment processing is conducted through secure third-party providers.

6.1 Free Trials

Where Skatrium offers a free trial period, the following applies:

  • The free trial period will be clearly stated at the point of sign-up.

  • No payment will be taken during the free trial period.

  • At the end of the free trial, your subscription will automatically convert to a paid plan at the applicable rate, unless you cancel before the trial expires.

  • You may cancel at any time during the free trial via your account settings, the Apple App Store, or the Google Play Store as applicable, without charge.

  • Skatrium reserves the right to modify or withdraw free trial offers at any time for new users, without affecting trials already in progress.

6.2 Subscription Auto-Renewal

Subscriptions are billed on a recurring basis (monthly, quarterly, bi-annually, or annually, as selected at sign-up).

Your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date.

You can manage or cancel your subscription at any time via your account settings or through the Apple App Store or Google Play Store where applicable.

Cancellation takes effect at the end of the current billing period; no partial refunds will be issued for unused time except where required by law.

7. Refunds Policy

7.1 Platform Fees

Fees paid directly to Skatrium (subscriptions, promotional upgrades, listing fees) are non-refundable except where required by law.

Goodwill refunds may be issued at Skatrium's sole discretion and: are case-by-case, do not create precedent, and do not establish entitlement. Statutory rights, including those set out in clause 7.3, remain unaffected.

7.2 Consumer Cooling-Off Rights

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a subscription within 14 days of purchase (the "cooling-off period") without giving a reason.

However, by accessing or using any paid feature of the platform immediately after purchase, you expressly request that performance of the service begins during the cooling-off period. By doing so, you acknowledge that your right to cancel will be lost once the service has been fully performed, and that if you cancel during the cooling-off period before full performance, you may be charged a proportionate amount for the service already provided.

If you wish to exercise your right to cancel within the cooling-off period and have not yet accessed paid features, please contact us via the Contact Us link on the Skatrium app or  website.

7.3 Event Tickets & Product Sales

Skatrium is not the organiser or seller of third-party events or goods.

When a user purchases:

  • An event ticket → the contract is with the organiser

  • Merchandise → the contract is with the merchant

  • DJ services → the contract is with the DJ

Refunds must be handled by the relevant provider in accordance with their policies and applicable law. Skatrium may assist in facilitating refunds but is not legally responsible for issuing them unless required by law.

8. Data Protection & Privacy

Skatrium processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

By using the platform, you acknowledge that your personal data will be collected and processed as described in our Privacy Policy, which is available at www.skatrium.com/privacy-policy.

Our Privacy Policy forms part of these Terms and explains: what data we collect and why, how we use and store it, your rights as a data subject, and how to contact us with data-related queries.

You agree not to upload or share personal data of third parties without their consent.

9. Limitation of Liability

To the fullest extent permitted by law, Skatrium is not liable for:

  • Event cancellations or changes

  • Personal injury at events

  • DJ performance disputes

  • Defective products

  • Shipping failures

  • Loss of profits or business interruption

  • Indirect or consequential losses

Where liability cannot be excluded, Skatrium's total liability is limited to the amount paid directly to Skatrium in the preceding 12 months.

Nothing excludes liability where unlawful to do so.

10. Account Suspension

Skatrium may suspend or remove accounts that:

  • Breach these Terms

  • Provide false information

  • Pose safety risks

  • Engage in fraud or unlawful conduct

11. Intellectual Property

All Skatrium branding, software, design, and proprietary content remain our intellectual property.

Third parties retain ownership of their uploaded content but grant Skatrium a non-exclusive licence to display and promote it within the platform.

12. Complaints & Dispute Resolution

12.1  If you have a complaint, please contact us in the first instance at support@skatrium.com. We aim to acknowledge complaints within 5 business days and resolve them within 28 days.

12.2  Where a dispute cannot be resolved informally, both parties agree to attempt mediation before commencing legal proceedings.

12.3  Nothing in this clause prevents either party from seeking urgent injunctive or other interim relief from a court of competent jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the platform constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Section 2: Organiser Agreement

In addition to Section 1, organisers agree:

1. Accuracy

All event listings must be accurate and promptly updated.

2. Responsibility for Events

Organisers are solely responsible for:

  • Safety and crowd management

  • Venue compliance

  • Insurance coverage

  • Staffing and equipment

  • Ticket fulfilment

  • Refund processing

  • Customer communications

Skatrium does not assume liability for event operations.

3. Insurance Requirement

Organisers must maintain appropriate public liability insurance and comply with applicable regulations.

4. Indemnity

Organisers agree to indemnify Skatrium against claims arising from:

  • Event-related injury

  • Contractual disputes

  • Regulatory breaches

Section 3: DJ Agreement

DJs are independent professionals. Skatrium does not employ, manage, or guarantee DJs.

DJs are responsible for:

  • Performance delivery

  • Equipment

  • Insurance (where applicable)

  • Compliance with local laws

  • Contractual agreements

DJs indemnify Skatrium against claims arising from service delivery.

Section 4: Merchant (Shop) Agreement

1. Independent Status

Merchants operate independently. Skatrium facilitates listings and payments but is not the seller of record unless explicitly stated.

2. Merchant Responsibilities

Merchants are responsible for:

  • Product safety

  • Accurate descriptions

  • Fulfilment and shipping

  • Returns and refunds

  • Compliance with consumer protection laws

3. Prohibited Products

Merchants may not sell illegal, counterfeit, unsafe, or regulated goods without proper authorisation.

4. Indemnity

Merchants agree to indemnify Skatrium against claims arising from:

  • Defective products

  • Consumer disputes

  • Regulatory violations
